Personal data & privacy

We collect the personal data strictly needed to process your order: name, delivery address, email address, and phone number where provided. Payment details are entered directly on Stripe's secure checkout and are never stored on our servers — Stripe processes and stores that data as an independent data controller under its own privacy policy.

We use your data only to fulfil your order, communicate with you about it, and comply with our legal (tax and accounting) obligations. We do not sell or rent your data to third parties. Order and invoice records are kept for 6 years as required by Spanish commercial law (Código de Comercio, art. 30).

Under the GDPR, you can ask us to access, correct, delete, or export your data, or to limit or object to how we use it, at any time by writing to hola@surfsafe.es. If you feel we haven't resolved a concern, you can also lodge a complaint with the Spanish Data Protection Agency (aepd.es).

Terms & Conditions of Sale

1. Scope

These Terms & Conditions govern the sale of products through surfsafe.es by Solid Wave S.L. ("Surf Safe", "we", "us"). By placing an order, you accept these terms in full. They apply to consumers residing in Spain and other EU member states.

2. Products & pricing

We currently sell one product: the Surf Safe helmet hat, one size (up to 62 cm), in turquoise/blue two-tone, priced at €55. All prices shown include Spanish VAT (IVA) where applicable.

We describe our product as accurately as possible, but colours may vary slightly on screen. We reserve the right to correct pricing or listing errors before an order is confirmed.

3. Orders & payment

Orders are placed through our Stripe-hosted checkout. Your order is confirmed once payment is successfully processed and you receive a confirmation email — that email, together with these terms, forms the contract of sale between you and Solid Wave S.L.

We accept the payment methods offered at checkout (cards and any other method Stripe makes available). We reserve the right to cancel and refund an order if we reasonably suspect fraud or if the product is unexpectedly out of stock.

Delivery terms, costs, and timelines are set out in our Shipping Policy below, which forms part of these terms.

5. Right of withdrawal

As an EU consumer, you have a 14-day right of withdrawal from any purchase, without needing to give a reason. Full details are in our Returns & Refunds Policy below.

6. Legal warranty

All products sold include the statutory legal warranty for new goods sold to consumers in Spain: 3 years from delivery, under Royal Decree-Law 7/2021 (transposing EU Directive 2019/771). If your hat arrives defective or develops a manufacturing fault, contact hola@surfsafe.es and we will repair, replace, or refund it at no cost to you, as appropriate under the law.

The legal warranty does not cover damage from normal wear and tear, misuse, or impacts absorbed by the helmet insert doing its job.

7. Liability

The Surf Safe helmet hat is designed to reduce the risk and severity of head impacts in watersports use, but it is not a substitute for a certified impact helmet and cannot eliminate all risk of injury. Use it as one part of sensible, conservative risk management on the water.

Nothing in these terms limits any liability that cannot be limited under Spanish or EU consumer protection law.

8. Intellectual property

All content on this website — text, images, logo, and design — belongs to Solid Wave S.L. or its licensors and may not be reproduced without permission.

9. Governing law & disputes

These terms are governed by Spanish law. As a consumer, you may bring proceedings before the courts of your own place of residence or those of Denia (Alicante), at your choice, and you may also use the EU's Online Dispute Resolution platform at ec.europa.eu/consumers/odr.

10. Changes to these terms

We may update these terms from time to time; the version in force at the time you place an order is the one that applies to that order.

Shipping Policy

Where we ship

We currently ship to mainland Spain, the Balearic Islands, and the rest of the European Union. We don't yet ship outside the EU — contact us and we'll let you know if that changes.

Costs & timelines

Spain (peninsula & Balearic Islands): Flat rate of €3.00 — dispatched within 2–3 business days, delivered in 2–4 business days via tracked courier.
Rest of the European Union: Flat rate of €5.99 — dispatched within 2–3 business days, delivered in 5–9 business days via tracked courier.

Customs & duties

Because we only ship within the EU, there are no customs duties or import VAT to pay on delivery — the price you see at checkout is the final price.

Tracking & delays

You'll receive a tracking link by email as soon as your order is dispatched. Estimated delivery times are our best expectation, not a guarantee — occasional delays with our courier partners are outside our control, and we'll help you chase a shipment that's running late.

Delivery address

Please double-check your delivery address at checkout — we dispatch to exactly what you enter. If a parcel is returned to us because of an incorrect address, we'll contact you to arrange re-shipment, and a second delivery fee may apply.

Damaged or lost parcels

If your hat arrives damaged, or your tracking shows it as delivered but you never received it, email hola@surfsafe.es within 7 days with your order number and, if possible, photos. We'll sort out a replacement or refund with you directly.

Returns & Refunds Policy

Your 14-day right of withdrawal

Under EU consumer protection law, you can cancel your order and return your Surf Safe hat within 14 calendar days of receiving it, for any reason, without justification.

To exercise this right, just email hola@surfsafe.es within that 14-day window, with your order number and a note that you'd like to return your item — a simple "I'd like to return my order" is enough, no form required.

Condition of returned items

Please return the hat unworn, with the removable helmet insert, chin strap, and all original packaging included, so we can resell it. You're welcome to try it on and check the fit, but you're liable for any loss in value caused by handling beyond what's reasonably needed to check the product — for example, visible wear, odour, or a damaged insert.

Who pays for return shipping

If you're returning from Spain, return shipping is free — email us and we'll send you a prepaid return label.

If you're returning from another EU country, you'll need to cover the cost of sending the item back to us at the address below. We recommend using a tracked service, since we can't refund an item that gets lost on its way back to us.

Refunds

Once we receive and check the returned hat, we'll issue your refund to the original payment method within 14 days — in practice, usually within 3–5 business days. We'll email you as soon as it's on its way.

If the returned item shows more wear than needed to check it, we'll deduct a reasonable amount reflecting that loss in value from your refund and let you know why.

Faulty or defective items

A manufacturing defect isn't a normal return — it's covered separately by the 3-year legal warranty described in our Terms & Conditions. If something's actually wrong with your hat, tell us and we'll fix it at our cost: repair, replacement, or refund, whichever makes sense.

Exchanges

Surf Safe ships in one adjustable size, so we don't offer size exchanges. If you'd like a different colourway when we release one, simply return your original order under the policy above and place a new one.
